Eau potable: Gaspé cesse son combat juridique

GASPÉ,, Qc – La Ville de Gaspé met fin à la contestation d’un jugement de première instance qui invalidait son règlement municipal sur la protection de l’eau potable face à l’exploitation des hydrocarbures en milieux habités.

Le conseil municipal de Gaspé a ainsi adopté lundi soir une résolution qui met un terme aux procédures judiciaires.

La Cour supérieure a tranché en février dernier que Gaspé avait outrepassé ses pouvoirs en adoptant ce règlement municipal. Ce verdict donnait donc raison à Pétrolia, qui contestait la validité de ce règlement.

Le mois suivant, le maire de Gaspé, Daniel Côté, déposait une contestation en Cour d’appel du Québec pour casser le jugement de première instance. Le conseil municipal avait entamé cette démarche en raison de l’absence de règlement provincial en matière de protection de l’approvisionnement en eau potable.

Le gouvernement du Québec a toutefois déposé sa réglementation en juillet dernier, et Gaspé s’était engagée à retirer son recours lorsque le vide juridique serait comblé.

Toutefois, les élus municipaux trouvent toujours inapproprié de forer des puits de pétrole en milieu habité, et s’opposent à la fracturation sur le territoire de Gaspé. Le conseil a donc adopté une série de résolutions demandant à Québec de prendre ses responsabilités maintenant qu’il a pleine juridiction sur la protection de l’eau potable.

Gaspé demande aussi au gouvernement de s’assurer de l’acceptabilité sociale des projets, et de meilleures retombées pour les communautés touchées par le développement des hydrocarbures.

Drinking water: Gaspé ends legal fight

The town of Gaspé ends its challenge of its first instance jugement that invalidated its municipal bylaw on the protection of drinking water from hydrocarbon exploitation in inhabited areas.

The municipal council of Gaspé passed a resolution Monday night putting an end to judicial procedures.

Superior Court had ruled last February that Gaspé had exceeding its powers by voting in this municipal bylaw. This verdict was in favor of Petrolia that was challenging the validity of this bylaw.

Then, the next month, Daniel Côté, Mayor of Gaspé, filed a challenge in Quebec's Appeals Court to strike that ruling. The municipal council had started that procedure because of the abscence of a provincial regulation that protects drinking water sources.

The Quebec government then filed its regulation last July, and Gaspé had promised to remove its appeal when the judicial void would be covered.

But the municipal elected officials still think it is inappropriate to drill oil wells in inhabited areas, and are against fracking in the Gaspé territory. The council has then voted in a series of resolutions asking for Quebec to take its responsabilities now that the province has full juridiction over drinking water protection.

Gaspé also is asking the government to insure the social acceptability of projects, and better benefits for impacted communities by the development of hydrocarbons.



Appel contre petrolia!

Je suis très triste d’apprendre que le conseil de Gaspé laisse la place pétrolia. Vous laissez tomber quatre années de travail bénévole de plus de 120 comités au Québec. Jamais je n’oublierai ce manque de solidarité du maire et de son conseil. D’ailleurs tout le Québec et les générations futures sans souviendront. Je ne peux qualifier ce manque de solidarité que de manque de jugement, d’intérêt à protéger et adopter le principe de précaution dans ce dossier.

Je pourrai qualifier cette décision comme un grand manque de respect pour le travail bénévole de grand homme comme docteur en droit Richard E Langelier et son équipe du collectif scientifique et des rapports et études qui vous ont été fournis gratuitement. Si une facture vous serait présentée avec ses experts elle dépasserait le quart de million.

Je passe trois semaines à grand Métis à tout les ans et je suis un touriste comblé quand je partage la beauté de la nature avec les amis et des repas de Matane à Rimouski et Sainte Anne des plaines jusqu’à Gaspé et de Percé à Ristigouche la Vallée de la Matapédia à Mont Joli. J’ai remarqué cette année sur le fleuve les activités pétrolières par bateaux et une petite odeur de pétrole. Que faite vous à cette belle région? Comment pouvez-vous dormir le soir en trahissant des gens qui vous ont supportés gratuitement qui ont bâtis un fond spécial pour votre défense.

Jamais la Gaspésie ne sera la même dans mon cœur. Heureusement il existe des gens comme Lise Chartrand, Maude Prudhomme, et des comités ensemble pour l’avenir du Grand Gaspé pour défendre l’avenir des générations futures.

Les Anglais disent : Shame on you. Honte à vous.

Et ceci est mon opinion personnelle, mais reflète l’assentiment général dans ce dossier par des milliers d’amoureux de Gaspé.

Je vous souhaite de l’eau potable et du touriste qui s’intéressent au gaz plus que de la nature, parce que pour les amoureux de la nature Gaspé sera perçue comme la porte d’entrée aux pétrolières et un conseil pas de colonne.

Call against Petrolia!

I am very sad to learn that Gaspé council is giving up against Pétrolia. You are letting down four years of volunteer work of more than 120 committees in Quebec. Never will I forget this lack of solidarity from the Mayor and his council. For that matter, all of Quebec and future generations will remember. I can only qualify this kind of lack of solidarity as a lack in judgment, lack of interest in protecting and following the precautionary principle in this file.

I could qualify this decision as being a lack of respect for the volunteer work of a great man like doctorate in law Richard E. Langelier and his team of the scientific collective and the reports and studies that were made available to you without charge. If a bill was sent to you from these experts, it would be for more than a quarter million. I spend three weeks at Grand Métis every year and I am a fulfilled tourist when I share nature's beauty with friends and meals from Matane to Rimouski and Sainte-Anne-des-Plaines, up to Gaspé and Percé to Ristigouche, in the Matapedia Valley to Mont-Joli.

I noticed, this year on the (St. Lawrence) River, oil company activity on the water and a slight smell of petrol. What are you doing to this nice region? How can you sleep at night when you betray people that have backed you for free, that put up a special fund to help you pay for your defense.

Never the Gaspesie Peninsula will be the same in my heart. Luckily, there are people like Lise Chartrand, Maude Prud'homme, and the committee Comité Ensemble pour l'Avenir du Grand Gaspé to defend future generations.

The English have a saying: Shame on you!

And this reflects my own opinion, but a general feeling of this file from the thousands that love Gaspé.

I wish you drinking water and tourism that prefer gas to nature, because for those who love nature, Gaspé will become the welcome mat for the oil companies and a council with no guts.
